APPLICATION OF THESE TERMS OF USE

These Terms of Use (“Terms of Use”) govern and apply to the contractual relationship between us and you arising from your access to, browsing of, and use of our Service.

In these Terms of Use, “our Service” or “the Service” means the personalised service for discovering, accessing and viewing content currently branded as “Dubai+” (and any successor or rebranded service), including all related features and functionalities, services, recommendations, websites, applications, products, user interfaces, as well as all content, coding, software and technologies associated with the Service.

The Service may be accessed via the Internet through compatible and authorised devices, including smart TVs, computers, mobile phones, set-top boxes, gaming devices, tablets and other similar devices (collectively, the “Authorised Devices”).

The Service is owned and/or operated by Dubai Media Incorporated, duly registered in Dubai, United Arab Emirates, hereinafter referred to as “DMI”, with its principal place of business located at Oud Metha – Umm Hurair (2), P.O. Box 835, Dubai, UAE (“we”, “us”, “our”).

References to “you” or “your” mean the individual who ultimately controls use of and/or access to the Service, and where applicable, any adult authorised by the account holder to access or use the Service through that account.

Please read these Terms of Use carefully before accessing or using the Service. By accessing, browsing, registering for, or using the Service, you confirm that you have read, understood, and agree to be legally bound by these Terms of Use. If you do not agree, you must not access or use the Service.

We may amend or update these Terms of Use at any time. Any changes will be posted on this page and will take effect from the date of publication unless stated otherwise. Your continued use of the Service after publication constitutes acceptance of the updated Terms of Use.

TERMS OF USE

You must be at least eighteen (18) years of age, or the age of legal majority in your country of residence (whichever is higher), to create an account or use the Service. Certain content or features may be subject to additional age restrictions.

Where permitted by law, minors may only use the Service with the consent and supervision of a parent or legal guardian, who remains responsible for the minor’s compliance with these Terms of Use.

Subject to your compliance with these Terms of Use, you are granted a limited, non-transferable, non-exclusive, non sublicensable licence to access and use the Service and any content made available through it solely for your personal, private and non-commercial use.

You may not share the Service with individuals outside your household or use it for any commercial, public or business purpose unless expressly authorised by DMI in writing.

You agree to use the Service strictly in accordance with these Terms of Use and all applicable laws and regulations. Without limitation, you agree that you shall not, and shall not permit any other person to:

• Copy, download, reproduce, distribute, modify, display, translate, publish, license, sell, rent, lease, create derivative works from, or otherwise use any content obtained through the Service, except as expressly permitted under these Terms of Use.
• Circumvent, disable or interfere with any content protection or digital rights management systems; use automated means (including bots, spiders or scrapers) to access the Service; reverse engineer or decompile any software; insert malicious code; or engage in data mining or extraction.
• Use the Service for any commercial, advertising, marketing or unauthorised purpose, including the transmission of spam or bulk electronic communications, unless authorised in writing by DMI.
• Incorporate the Service or any part of it into any other programme or product. DMI reserves the right to refuse service or terminate accounts at its sole discretion.
• Impersonate any person or entity, or misrepresent your identity or affiliation, including giving the impression that user-generated content originates from the Service.
• Harass, intimidate, abuse or threaten others, or promote sexually explicit content, violence, hate speech or discrimination based on protected characteristics.
• Use or attempt to use another person’s account, credentials or systems without proper authorisation, or create a false or misleading identity.
• Use the Service in a manner that creates a conflict of interest or undermines the integrity or purpose of the Service, including trading or fabricating reviews.
• Use the Service for unsolicited advertising, chain letters, pyramid schemes or other prohibited solicitations.
• Engage in or facilitate any fraudulent, unlawful or criminal activity.
• Use artificial intelligence tools, deepfake technology or automated processes to manipulate, misrepresent or generate deceptive content based on Service materials, including:
• Creating altered or synthetic media that distorts original content;
• Falsely attributing statements or endorsements;
• Distributing AI-altered content that may mislead or harm DMI, content owners, talent or third parties.

Any violation may result in immediate suspension or termination of your account and legal action.

DMI reserves the right to modify, suspend or discontinue the Service or any part of it at any time without notice and shall not be liable for any interruption or unavailability.

DMI may make Dubai+ content available on third-party platforms or broadcasters.

DMI does not control third-party platforms and does not guarantee continued availability of content on such platforms.

DMI shall have no liability if Dubai+ or its content becomes unavailable on any third-party platform during your subscription to that platform.

SERVICE AVAILABILITY AND SOFTWARE USE

DMI will use reasonable efforts to provide continuous access to the Service; however:

Content may be modified or removed at any time without notice.

Service software may vary by device and may require third-party software subject to separate licences.

You are responsible for all equipment, devices, internet access and associated costs.

COMMUNITY GUIDELINES

Our Service may contain features and functionality where you can discover, create, upload, share, post, comment, transmit or connect with other users of our Service (“User Content”). Except for minors, such features and functionality are available to all users of the Service, whether free or paid users. We may however limit the use of such features such as all users may be able to view, like, and share reels from such feature to third-party platforms, including but not limited to social media, email, and WhatsApp but only paid users can post comments.

In addition to any other terms of use contained herein, whenever you access or use a feature that allows you to upload or transmit User Content through the Service (including via certain thirdparty social media platforms such as Instagram, Facebook, YouTube, Twitter), you must, at all times, be compliant with the following community guidelines. As noted above, these features may not be available to all users of the Service, and we have no liability to you for limiting your right to certain features of the Services.

The following community guidelines may not cover every type of rule or guideline that you must follow when using such features and functionality of our Service.

If you are ever in doubt about what is permitted, please remember to be kind and treat others the way that you would want to be treated.

These community guidelines apply to all types of user content on such features and functionality of the Service, including without limitation, content, videos, comments, likes, links and shares. We enforce these community guidelines using a combination of human reviewers and machine learning and apply them to everyone equally, regardless of the subject or the users background, political viewpoint, position, or affiliation.

In respect of any User Content, you agree not to:

• use any private information of any third party, including addresses, phone numbers, email addresses, number and feature in the personal identity document or credit card numbers. • post any material which does or may infringe any copyright, trademark or other intellectual property or privacy rights of any other person.
• post any material which is defamatory of any person, obscene, offensive, pornographic, hateful or inflammatory.
• post any material that would constitute, encourage or provide instructions for a criminal offence, dangerous activities or self-harm.
• post any material that is deliberately designed to provoke or antagonise people, especially trolling and bullying, or is intended to harass, harm, hurt, scare, distress, embarrass or upset people.
• post any material that contains a threat of any kind, including threats of physical violence.
• post any material that is racist or discriminatory, including discrimination on the basis of someone’s race, religion, age, gender, disability or sexuality.
• publish any answers, responses, comments, opinions, analysis or recommendations that you are not properly licensed or otherwise qualified to provide; or
• material that, in our sole judgment, is objectionable or which restricts or inhibits any other person from using the Service, or which may expose us, the Service or its users to any harm or liability of any type.

You warrant that any User Content that you contribute does comply with these Terms of Use and community guidelines, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any User Content will be considered non-confidential and non proprietary.

You must not post any User Content on or through the Service or transmit to us any User Content that you consider to be confidential or proprietary. When you submit User Content through the Service, you agree and represent that you own that User Content, or you have received all necessary permissions, clearances from, or are authorised by, the owner of any part of the content to submit it to the Service, to transmit it from the Service to other third party platforms, and/or adopt any third party content.

You grant us a royaltyfree licence to use your username and contact information to identify you as the source of any of your User Content. We also have the right to disclose your identity to any third party who is claiming that any User Content posted or uploaded by you to our Service constitutes a violation of their intellectual property rights, or of their right to privacy.

We, or authorised third parties, have the right – but not the obligation - to remove, disallow, block or delete any posting you make on our Service. No compensation or justification will be provided for the removal of User Content.

We accept no liability in respect of any User Content submitted by users and published by us or by authorised third parties. If you wish to file a complaint about information or materials uploaded by other users, contact us via the Contact Us section of our Service.

By using any feature of the Service which permits User Content, you acknowledge that your interactions may be collected and processed in accordance with our Privacy Policy. If you are a paid subscriber to our Service, you consent to your User Content being displayed publicly.

If you share any shareable content that we publish on the Service via third-party platforms, you do so at your own risk and you must comply with the respective platform’s terms of service. We are not responsible for how third-party platforms handle sharable content or your data.

USER ACCOUNT AND PASSWORDS

The individual who creates the account and whose payment method is charged is the Account Owner and is responsible for all activity under the account.

You must ensure that all information provided to DMI is accurate and complete and must not impersonate or misrepresent any person or entity.

You are responsible for maintaining the confidentiality of your username and password. For minor profiles, parents or guardians are solely responsible for restricting access to mature content.

You must notify DMI immediately of any unauthorised use or security breach involving your account.

CONTENT

All content and intellectual property on the Service are the exclusive property of DMI, Dubai+ or its licensors.

No ownership rights are transferred to you by virtue of accessing the Service.

Content availability may vary by geography, device and licensing restrictions.

Offline viewing, streaming quality and parental controls are subject to technical and subscription limitations.

USER SUBMISSIONS

All submissions (feedback, ideas, suggestions) become the property of DMI and may be used without compensation or obligation of confidentiality.

COPYRIGHT INFRINGEMENT

DMI is not responsible for third-party websites linked through the Service.

ACCESS PLANS, PAYMENTS & CANCELLATION

Access may be provided via AVOD, SVOD, bundled plans, vouchers, gift cards or third-party billing platforms.

Subscriptions renew automatically unless cancelled prior to the renewal date.

Fees are non-refundable except where required by law.

TERMINATION

DMI may suspend or terminate access to the Service at any time for breach of these Terms or at its sole discretion.

INDEMNIFICATION

You agree to indemnify and hold harmless DMI from any claims arising from your use of the Service or violation of these Terms.

DISCLAIMER OF WARRANTIES

The Service is provided “as is” and “as available”, without warranties of any kind.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, DMI shall not be liable for indirect, incidental or consequential damages arising from use of the Service.

GENERAL

These Terms are governed by the laws of the United Arab Emirates.

Exclusive jurisdiction lies with the courts of Dubai, UAE.

If any provision is held invalid, the remaining provisions remain in effect.
